Requesting Health Records

In accordance with Texas Health & Safety Code §181.105, you have the right to request access to your own health care records maintained by your clinician. By submitting a records request through this website, you acknowledge and understand that:
This request is for your own health care records or records you are legally authorized to receive. Your clinician may require verification of your identity prior to releasing any records to protect your privacy. Records may be provided in electronic or paper format, depending on availability and legal requirements. Reasonable fees, as permitted by law, may apply for copying, preparation, or delivery of records. Requests are processed within timelines required by applicable state and federal law; submission of this request does not guarantee immediate access.

Your clinician reserves the right to limit or deny access to some or all requested health care records if, in their professional judgment, releasing the information could reasonably be expected to cause harm, negatively impact your mental or emotional well-being, or otherwise not be in your best interest, as permitted by law. In such cases: Access may be restricted, delayed, or provided in an alternative format, such as a treatment summary. Your clinician may recommend that records be reviewed together in session to support understanding and emotional safety. 

Any denial or limitation of access will be handled in accordance with Texas and federal law, and you may be informed of your right to request a review of the decision when applicable. You will receive written notice of denial of any health records requests within 15 days. This request is intended to provide access to existing clinical records and does not replace direct communication with your clinician regarding your treatment, diagnosis, or care.

How to File a Report or Complaint with a Professional’s Licensing Board

Any violations of the Texas Occupations Code or Health & Safety Code by a licensed person can be reported to the Texas Behavioral Healthcare Council. Complaints must be submitted using the Council’s complaint form. The completed form can be sent by email to enforcement@bhec.texas.gov or by mail to 1801 Congress Avenue, Suite 7.300, Austin, Texas 78701. Click the link below for instructions and form.
